Every Ballot Counts

2026 midterms · watching through Jan 3

The federal government built itself a way to decide who's a "real" voter. We read the fine print.

New orders, a federal fraud center, data deals and a citizenship check that runs outside the system states use. It is already sending states lists of named voters and asking them to hold those ballots. We track every piece from public records and watch for the moment it gets switched on.

Why I started this

Since Trump took office in 2025, the federal government has overhauled how data can be shared between agencies. States run elections, yet the federal government has built a legal framework to insert itself, using its limited national-security, immigration and election-integrity oversight roles. The head of OMB said before taking office that he wanted the military available to put down post-election protest. The President told the New York Times in January 2026 that he regretted not having the National Guard seize voting machines after 2020, and told us to expect a "big surprise." The Attorney General has raised the possibility of a "doomsday scenario." Anyone with a working knowledge of how elections are run, which systems share election data and who controls them can see that something has changed. As an attorney who believes deeply in the right to vote, I am concerned that this new federal infrastructure and data flow is a concerted effort to undermine a free and fair 2026 election.

To stop it, we need to understand what is possible so we know what to look for. The working theory is that existing systems, new functionality, sweeping task-force and fraud-unit designations, and a USCIS fraud office turned into a law-enforcement unit have together created an IT environment that would let the government try to determine the outcome of the 2026 midterms on a fabricated or overblown justification. The huge increase in ICE personnel and presence works as both normalization and a chilling effect.

For voters, it starts with a claim that China hacked state voter rolls, or that Chinese parts in voting machines are compromised. From there, the federal government has built its own way to decide who is a "real" voter. It works outside SAVE and outside the state systems courts have been able to reach, and it is already handing states lists of named voters and asking that their ballots be held. Our worry is what comes next: a cyber incident blamed on a foreign country, the FBI taking over the "investigation" and the evidence, and a federal list used to set aside ballots or challenge certification before Jan 3. For candidates, the same tools are being pointed at people on the ballot: a federal probe of Rep. Ilhan Omar's citizenship papers. Every piece exists on paper today. We are watching for the earliest signals that they are being turned on.

What we're watching for

  • A 2021 law lets the DHS Secretary alone declare a "significant incident," and harm to "public confidence" counts.D
  • The FBI says investigating foreign interference in elections is its job.D
  • The worry: a hack blamed abroad, evidence in federal hands, and a federal list used against certification.I
  • Nothing has been declared. Watch the Federal Register.

Call your representatives

What to demand

Don't want another state calling you a fraud?Demand the Fraud Detection Center disclose what voter data it holds, which states feed it, and who sees the matches.
Like your ballot where it is?Demand a written DOJ pledge: no seizure of ballots, machines or voter rolls before certification, including by grand-jury subpoena.
Rather not be flagged by a people-search site?Demand the matching rules and an error rate before any federal "noncitizen" list reaches a state.
Not a fan of surprise emergencies?Demand that any "significant incident" tied to an election come with public evidence, not just a Federal Register notice.
Have a passport?Demand the State Department name its "verification platforms" before Nov 23, and show how a mismatch gets fixed.
Think privacy rules should apply to everyone?Demand the fraud center and inspectors general follow the computer-matching law: notice, agreements and a check before anyone is accused.
